Although OSHA will not have specific regulations for every tool in the workplace - like a wheelbarrow - OSHA does have general requirements that can be taken into consideration in your scenario.

For example 29 CFR 1926.21(b)(2) states: The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury

Under this, the employer should have instructed the worker on the safe operation of the wheelbarrow and conditions where using the wheelbarrow is unsafe.

Another consideration is that OSHA states the employer is responsible for the safe condition of tools and equipment used by employees, but the employees have the responsibility for properly using and maintaining tools.

If the wheelbarrow missing one of the legs caused a foreseeable unsafe work condition it needs to be removed from service and repaired or replaced.</description>
